1. About these Terms

These Terms and Conditions ("Terms") govern your use of the website at www.harrisonecotours.com (the "Website") and your purchase of and participation in any tour, rental, package, gift card or other product or service offered by Harrison Eco Tours (each, a "Service").

Harrison Eco Tours is operated by [LEGAL ENTITY NAME], a company incorporated in British Columbia, Canada, with its principal place of business at 100 Esplanade Avenue, Harrison Hot Springs, British Columbia V0M 1K0. In these Terms, "we", "us" and "our" mean that company, and "you" and "your" mean the person using the Website or booking or participating in a Service.

By using the Website, making a booking, or participating in a Service, you agree to these Terms. If you are booking for other people, you do so as their agent, and you confirm that you have their authority to accept these Terms on their behalf and that you have brought these Terms to their attention. If you do not agree to these Terms, do not use the Website and do not book with us.

Please read these Terms alongside our Privacy Policy, which forms part of them.

2. Who may book

You must be at least 19 years of age (the age of majority in British Columbia) and have the legal capacity to enter into a binding contract in order to make a booking. Participants under 19 may take part in a Service only with the consent and, where required, the accompaniment of a parent or legal guardian, and a parent or legal guardian must sign the waiver on their behalf.

Specific age and supervision rules apply to our activities:

  • Children aged 12 and over may join kayak tours in a tandem kayak with an adult.
  • Participants under 16 should not paddle a single kayak on their own.
  • All participants under 16 must be accompanied by a parent or guardian at all times, and a signed waiver is required.
  • Additional or different age limits may apply to particular tours and are stated on the relevant tour page.

3. Using the Website

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your own personal, non-commercial purposes, and to make bookings with us. You must not:

  • use the Website for any unlawful, fraudulent or harmful purpose;
  • make any speculative, false or fraudulent booking, or any booking in anticipation of demand;
  • copy, reproduce, scrape, data-mine, frame, mirror or republish any part of the Website except as expressly permitted;
  • use any robot, spider, scraper or other automated means to access the Website without our written permission;
  • attempt to gain unauthorised access to the Website, its servers, or any connected system;
  • introduce any virus, malware or other harmful code;
  • interfere with the proper working of the Website, or impose an unreasonable load on our infrastructure; or
  • use the Website in a way that infringes the rights of any other person.

We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have breached these Terms.

4. Intellectual property

All content on the Website — including text, photographs, video, graphics, logos, trade marks, page layout, design and software — is owned by us or our licensors and is protected by Canadian and international copyright, trade mark and other intellectual property laws. The names "Harrison Eco Tours", our logo, and our tour names are our trade marks.

You may view, download and print pages of the Website for your own personal use in connection with a booking. Any other use — including reproduction, distribution, modification, public display, or commercial exploitation — requires our prior written permission. Nothing in these Terms transfers any intellectual property right to you.

5. Content you submit

If you submit a review, testimonial, photograph, video, comment or other content to us or to our social media pages ("User Content"), you confirm that it is your own, that it is accurate, and that it does not infringe anyone else's rights or breach any law.

You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, adapt, publish and display that User Content in connection with our business, including in our marketing, on our Website and on social media, with attribution to your first name or display name unless you ask otherwise. You may ask us to stop using your User Content at any time and we will remove it from the channels we control as soon as reasonably practicable.

We may remove or decline to publish any User Content at our discretion, and we do not endorse and are not responsible for User Content submitted by others.

6. Bookings

6.1 Making a booking

You may book through our online booking system, by telephone on 604-316-4460, by email to info@harrisonecotours.com, in person at our office in the lobby of the Harrison Hot Springs Resort and Spa, or through an authorised reseller or travel partner.

A booking request is an offer by you to purchase a Service. A contract is formed only when we issue a written booking confirmation. If we cannot accept your booking — for example because the tour is full, the date is unavailable, or a pricing or availability error has occurred — we will tell you and refund any payment taken in full.

You are responsible for the accuracy of the information you give us at the time of booking, including names, participant numbers, ages, contact details and any special requirements. Check your confirmation carefully as soon as you receive it and tell us immediately if anything is wrong.

6.2 Errors

We take care to ensure that the information on the Website and in our booking system — including prices, availability, durations and descriptions — is accurate, but errors occasionally occur. We reserve the right to correct any error before or after a booking is confirmed. Where an error materially affects your booking, we will contact you and offer you the choice of proceeding at the corrected price, rebooking, or cancelling with a full refund.

6.3 Bookings made through third parties

If you booked through an online travel agency, hotel concierge, travel agent or other reseller, that party's own booking, payment and cancellation terms may also apply, and in some cases will govern your payment and refund. We are not responsible for errors made by a third-party reseller. Contact the party you booked with in the first instance for changes and cancellations.

7. Prices, taxes and payment

Currency. All prices are in Canadian dollars (CAD) unless clearly stated otherwise. If you pay with a card issued outside Canada, your card issuer sets the exchange rate and may apply a foreign transaction fee. We have no control over either.

Taxes. Prices are subject to applicable taxes, including 5% GST, which are shown at checkout unless stated as included.

What is and is not included. Each tour page sets out what is included. Unless stated, prices do not include transport to and from the meeting point, accommodation, meals, gratuities, personal expenses, travel insurance, or optional extras.

Gratuities. Gratuities for your guide are entirely at your discretion and are never added automatically.

Price changes. We may change our prices at any time. A price change will not affect a booking we have already confirmed, except where a tax rate or government-imposed charge changes, in which case we may pass on the difference.

Payment. [CONFIRM: whether payment is taken in full at the time of booking, or whether a deposit of [X]% is taken with the balance due [X] days before the tour, and whether the deposit is refundable. The wording below assumes payment in full at booking — replace if that is not correct.]

Payment is due in full at the time of booking unless we agree otherwise in writing. We accept the payment methods shown at checkout. Your booking is not confirmed until payment has been received and we have issued a confirmation. Payments are processed by our third-party payment processor; we do not store your full card details.

Groups and private charters. Different deposit, payment and cancellation terms may apply to private, group and corporate bookings, and will be set out in the quotation or booking confirmation for that booking. Where they differ, those terms take precedence over sections 7 and 8.

8. Changes and cancellations by you

8.1 Cancellation policy

Our cancellation policy for standard bookings is:

  • More than 30 days before your tour date: you may cancel for a full refund.
  • Within 30 days of your tour date, but more than 10 days before it: no refund is available, but we will issue a credit valid for the same season or the following season.
  • Within 10 days of your tour date: no refund and no credit will be issued.
  • Failure to attend (no-show), or arriving too late to join the tour: treated as a cancellation within 10 days — no refund or credit.

All cancellations must be made in writing to info@harrisonecotours.com. The cancellation takes effect on the date we receive your email, and the relevant window is measured from the scheduled start time of your tour, in Pacific Time.

Refunds are issued to the original payment method and normally reach you within 10 business days, depending on your card issuer. Credits are non-transferable and non-redeemable for cash unless we agree otherwise in writing.

8.2 Changes to your booking

We will do our best to accommodate a request to change the date, time or participant numbers of a booking, subject to availability. A change requested within the 10-day window may be treated as a cancellation and rebooking. Reductions in participant numbers are subject to the cancellation policy above.

8.3 Packages including accommodation

Where your booking includes a hotel stay or another supplier's service, that supplier's cancellation terms apply to their portion of the package and may be stricter than ours. These will be disclosed at the time of booking.

8.4 Bookings made through third parties

Where you booked through a reseller, that reseller's cancellation policy applies.

9. Changes and cancellations by us

Safety comes first. We may cancel, shorten, delay, reroute or otherwise modify any tour where, in the reasonable judgment of our guides or management, it is necessary for the safety of participants, staff or others. Reasons include severe weather (such as lightning, high winds, dangerous water conditions, wildfire smoke or poor air quality), river or lake conditions, mechanical failure, guide illness, a medical emergency, or the direction of any authority.

Weather generally. Our tours operate in rain or shine. Rain, cloud, cold or an absence of wildlife sightings is not, by itself, a reason for cancellation or refund. Boat tours operate in covered, heated vessels. We cancel only where conditions create a genuine hazard.

Minimum numbers. Some tours require a minimum number of participants to operate. If the minimum is not met, we may cancel and will offer you the options below.

If we cancel before the tour starts, we will offer you, at your choice: (a) a transfer to another date or another tour of equivalent value, subject to availability; (b) a credit valid for the same or the following season; or (c) a full refund of the amounts you paid us for the cancelled Service.

If we cut a tour short after it has begun for safety reasons, we will offer a partial refund or credit proportionate to the part of the tour not delivered, determined reasonably by us. Where a substantial majority of the tour was delivered, no refund may be payable.

The limit of our responsibility for a cancellation. A refund, credit or transfer as described above is your sole remedy for a cancellation or modification by us. We are not responsible for any other cost you incur as a result — including travel, accommodation, meals, car hire, connecting transport, missed events or lost holiday time. We strongly recommend travel insurance.

We may also substitute a guide, vessel, kayak, route or launch point where necessary, provided the Service remains substantially as described.

10. Arrival, meeting points and late arrival

Meeting points are stated in your booking confirmation. As a general guide, kayak tours meet at our office in the lobby of the Harrison Hot Springs Resort and Spa, and boat tours meet at the dock directly in front of the Resort. Confirm your meeting point on your booking confirmation, as it may differ.

Please arrive at least [X] minutes before the scheduled start time to complete waivers, receive your safety briefing and be fitted with equipment. Tours depart on time. If you arrive after the departure time, you may be refused participation and no refund or credit will be given. We cannot delay a departure for a late participant, as it affects every other guest on the tour and, on the water, our operating window.

11. Participation: safety, conduct and fitness

11.1 Waiver and release

Every participant must read and sign a Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement before taking part in any tour or rental. A parent or legal guardian must sign on behalf of any participant under 19. The waiver is a separate legal document from these Terms, and it will ask you to give up important legal rights, including the right to sue. You will be given an opportunity to read it. If you are not willing to sign the waiver, you will not be able to participate, and no refund will be given.

A copy of the waiver is available on request before you book. We encourage you to ask for it in advance if you would like time to consider it.

11.2 Fitness, health and self-assessment

You are responsible for assessing whether you and the members of your party are physically and medically fit to take part. Our kayak tours require the ability to sit in a kayak for the duration of the tour, to paddle, to get in and out of a kayak at the shoreline, and to follow instructions on the water. You should be comfortable being on and around water.

You must tell us before or at the time of booking about any medical condition, injury, disability, pregnancy, allergy, medication or mobility limitation that may affect your participation or that we would need to know in an emergency. We will do our best to accommodate you where it is safe to do so. We may decline participation where we reasonably consider that taking part would create an unacceptable risk to you or others.

11.3 Equipment limits

Our kayaks have manufacturer weight limits that we must observe for your safety:

  • Wilderness Systems Pungo 120 — maximum 325 lbs / 147 kg; cockpit 22" / 56 cm wide.
  • Wilderness Systems Pungo 140 — maximum 350 lbs / 159 kg; cockpit 22" / 56 cm wide.

Please tell us at the time of booking if any participant is close to or above these limits so we can discuss suitable options. We cannot allow a participant to use equipment beyond its rated limit.

11.4 Rules on tour

You must:

  • follow all instructions given by your guide at all times;
  • attend and pay attention to the safety briefing;
  • wear the personal flotation device and any other safety equipment provided, correctly fitted, at all times while on the water;
  • stay with the group and within sight of your guide unless told otherwise;
  • treat wildlife, the river, the lake and the surrounding environment with respect, and comply with all wildlife-viewing distances and environmental rules your guide sets; and
  • behave courteously towards other participants, our staff and members of the public.

You must not take part while under the influence of alcohol, cannabis or any other drug that impairs judgment or coordination. Alcohol and cannabis are not permitted on our tours or in our rental equipment.

11.5 Our right to refuse or remove

We may refuse to allow a person to begin, or may remove a person from, a tour or rental — without refund or credit — where in our reasonable opinion that person: is impaired by alcohol or drugs; is behaving in a manner that is unsafe, abusive, threatening, discriminatory or disruptive; refuses to follow a guide's instructions or to wear safety equipment; has misrepresented their age, fitness, weight or medical condition; or is otherwise unfit to participate safely. In those circumstances we accept no responsibility for any cost you incur, including return transport.

11.6 Personal belongings

You bring personal belongings on tour at your own risk. We are not responsible for loss of, or damage to, personal items — including phones, cameras, keys, glasses and jewellery — whether on our boats, in our kayaks, in the water or at our office. Waterproof storage is limited; leave valuables behind where you can.

11.7 Rental equipment

Where you rent equipment from us, you are responsible for it from the time it is issued to you until it is returned. You must return it on time and in the condition in which it was issued, fair wear and tear excepted. You are liable for the reasonable cost of repair or replacement of equipment that is lost, stolen or damaged beyond fair wear and tear while in your care, and for any additional charge for late return at our standard rental rates. You must operate rental equipment only within the area and conditions we specify, must wear the personal flotation device provided, and must not allow anyone else to use it.

12. Gift cards

Gift cards may be purchased through our booking system. Unless stated otherwise: gift cards are redeemable only against our Services; they are not redeemable for cash and are not reloadable; they are transferable but we are not responsible for a gift card that is lost, stolen or used without authorisation; and any booking made with a gift card remains subject to these Terms, including the cancellation policy. Consistent with British Columbia's Business Practices and Consumer Protection Act, gift cards we issue do not carry an expiry date on the funds, except where permitted by law (for example, promotional cards issued at no charge).

13. Assumption of risk

Please read this section carefully. It describes risks that are inherent in the activities we offer.

Kayaking, boating and other water-based outdoor activities involve inherent and significant risks, dangers and hazards that cannot be eliminated regardless of the care taken. These include, without limitation:

  • drowning, immersion, cold-water shock and hypothermia;
  • capsize, collision, falling from or striking a vessel or kayak, and entrapment;
  • moving water, currents, tides, waves, wind, wakes from other vessels, submerged or partly submerged obstacles including rocks, logs and deadheads, and changing river levels;
  • sudden or severe changes in weather, including storms, lightning, high wind, heat, cold and smoke;
  • slips, trips and falls on docks, boat ramps, shorelines, trails and wet or uneven ground, including on the walk associated with the Rainbow Falls tour;
  • encounters with wildlife, including bears, and with insects;
  • physical exertion, fatigue, dehydration, sunburn and exposure;
  • equipment failure or misuse;
  • the negligence of other participants or of other persons on the water;
  • remoteness from medical facilities, and consequent delay in obtaining medical assistance or evacuation; and
  • negligence on the part of Harrison Eco Tours, its owners, directors, officers, employees, guides, agents, contractors and volunteers, including a failure to safeguard or protect you from the risks described here.

By booking and participating, you acknowledge that you are aware of these risks, that you have had an opportunity to ask questions about them, and that you freely accept and fully assume all such risks and the possibility of personal injury, death, property damage and loss resulting from them.

We strongly recommend that you obtain travel, medical and cancellation insurance appropriate to the activities you have booked, and that you check that your policy covers guided kayaking and boating activities. We do not provide insurance for participants.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for anything that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence to the extent that such liability cannot lawfully be excluded, for fraud or fraudulent misrepresentation, or under the mandatory provisions of the Business Practices and Consumer Protection Act (British Columbia) or the Sale of Goods Act (British Columbia) that apply to you as a consumer.

Subject to that paragraph, and to the maximum extent permitted by law:

  1. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for loss of profit, revenue, enjoyment, opportunity or holiday time, however arising, whether in contract, tort (including negligence), under statute or otherwise, even if we have been advised of the possibility of such loss.
  2. Our total aggregate liability arising out of or in connection with a booking, a Service or your use of the Website is limited to the total amount you paid us for the Service giving rise to the claim.
  3. We are not liable for the acts or omissions of any third party we do not control, including accommodation providers, resellers, online travel agencies, transport providers, restaurants, other tour operators, and the operators of any venue, dock or launch site.
  4. We are not liable for any loss or damage arising from your failure to follow a guide's instructions, your misrepresentation of your fitness, age, weight or medical condition, or your breach of these Terms.
  5. The Website is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, secure, or free of viruses, and we are not liable for any loss arising from your use of, or inability to use, the Website.

Signed waiver prevails. The waiver and release you sign before participating is a separate agreement. Where its terms differ from this section, the signed waiver governs as between you and us in respect of participation in the activity.

15. Indemnity

You agree to indemnify and hold harmless Harrison Eco Tours, its owners, directors, officers, employees, guides, agents and contractors from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising out of or in connection with: your breach of these Terms; your negligent or wilful act or omission; loss of or damage to our equipment or property caused by you; or any claim brought by a person for whom you made a booking arising from your failure to bring these Terms and the waiver to their attention.

16. Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including: extreme or adverse weather; flood, drought, wildfire, smoke, earthquake or other natural disaster; epidemic or pandemic and any related public health measure or government order; war, terrorism, civil unrest or riot; strike or industrial action; failure of public or private telecommunications networks, utilities or transport; the closure of a waterway, dock, launch site or road; government or regulatory action; or the act, order or restriction of any public authority.

Where such an event prevents us from providing a Service, we will offer you a transfer, a credit or a refund in accordance with section 9, and that will be your sole remedy.

17. Complaints

If something goes wrong, tell your guide or a member of our team at the time, so that we have the opportunity to put it right on the spot. If your concern is not resolved, write to us at info@harrisonecotours.com within 30 days of the tour date, setting out what happened and what you would like us to do. We will acknowledge your complaint and respond in writing.

18. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

19. Third-party links and services

The Website links to third-party sites and services, including our booking system, payment pages, accommodation partners and social media. Those services are governed by their own terms and privacy policies. We do not control them, do not endorse them, and are not responsible for them.

20. Changes to these Terms

We may amend these Terms at any time by posting an updated version on the Website. The version in effect at the time you make a booking governs that booking. Your continued use of the Website after an update means you accept the amended Terms.

21. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province.

You and we submit to the exclusive jurisdiction of the courts of British Columbia, and agree that any proceeding will be commenced in Chilliwack or Vancouver, British Columbia. Nothing in this section limits any right you may have under mandatory consumer protection law in your country of residence to bring proceedings in your local courts.

22. General

  • Entire agreement. These Terms, together with our Privacy Policy, your booking confirmation and any waiver you sign, form the entire agreement between us in relation to your booking and supersede any earlier understanding.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, it will be severed or read down to the minimum extent necessary, and the remaining provisions will continue in full force.
  • No waiver. Our failure or delay in enforcing any provision is not a waiver of it.
  • Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations on notice to you, for example on a sale of our business.
  • No partnership or agency. Nothing in these Terms creates a partnership, joint venture or employment relationship between us.
  • Third parties. Except for the indemnities and limitations of liability, which our owners, directors, officers, employees, guides, agents and contractors may enforce, no person who is not a party to these Terms may enforce them.
  • Headings. Headings are for convenience only and do not affect interpretation.
  • Language. These Terms are drawn up in English. Where we provide a translation, the English version prevails.
